An eviction notice is used by landlords as a last resort after all other avenues have been exhausted to remove a tenant from a rental property. In the case of a homeowner, the bank or finance company will normally go through the courts and use a sheriff to deliver the notice. For most decent landlords having to evict a tenant may be one of the hardest things the ever have to do, in many cases it is because the tenant has failed to make their rent payments. Often the tenants are struggling and trying to make ends meet, feed their families and survive, being evicted is not going to help.

When you are a landlord, you are also a businessman and as such each rental you own must be bringing in money in order for you to survive. There is going to come a time that you are going to have to deal with evicting a tenant, to make sure that you follow all the correct state and local guidelines you should keep a sample eviction notice on hand. This will make it much easier to take care of the paperwork as you can use the sample to create the real notice that you can have served to the tenant.

The sample eviction notice that you use should have place on it to list your name and address and any rental agent or management company that you use. Is should also include the appropriate contact information such as phone numbers. Then there should be a place to list the tenant’s name and a description of why you are evicting him. Finally there needs to be a place to but the final date upon which the tenants must vacate the property.

In some areas the notice must be notarized and in others must be delivered by someone who is not related to you or your rental agency. You should always consult your local laws to make sure that you are fully in compliance so that your tenant has no legal recourse but to vacate the premises.
